Preliminary note: activities in a natural environment imply the acceptance of a potential risk derived from the nature of the suggested activities. The guides and technicians have the appropriate preparation and experience corresponding to the activity they carry out and do their best to avoid or minimize those risks, but these can not be eliminated. The safety during the activity depends, to a large extent, on following our instructions and guidelines.

About our activities

​

The client agrees to follow the instructions given by the guides in order to respect and protect the environment. Leaving all kinds of objects during the activity is forbidden.

​

The contracted activities are subject to the conditions of the environment in which they are carried out and to the people who participate, which is why they may undergo changes before or even during the activity (meteorology, sudden changes in water level, physical problems of the participants, etc.). In case of cancellation by Yepalo (Moshe Mizrahi ESX9825836Y), the client has the right to postpone the activity, replace it by another one, or to get a refund of the amount paid.

The client has the obligation to report possible pregnancy, paraplegia, cardiovascular diseases or any type of injury before hiring any activity. Likewise, the customer commits to not to be under the influence of alcohol, drugs and/or narcotics, as well as any other medication that may affect his/her ability to react. In order to participate in water activities, it is essential to know how to swim. The details of each activity specify the minimum conditions and age required to participate. Minors must have authorization or be accompanied by a responsible adult.

In any case, and especially for the activities of advanced level, Yepalo (Moshe Mizrahi ESX9825836Y) may choose to perform a pre-test and reserves the right of admission.

​

The client expressly declares, accepting this contract, to be informed of the minimum requirements related to the practice of the activity, which (s)he indicates to possess. The client assumes that (s)he hires a risky activity and understands the dangers that derive from it.

​

The reliability of Yepalo (Moshe Mizrahi ESX9825836Y) starts when the contracted activity begins, so it is the client's responsibility to transport him/herself to the facilities or to the place where the activity begins. The contract and the responsibility of Yepalo (Moshe Mizrahi ESX9825836Y) is exclusively related to the direct work of its technicians and the organization of the activity.

Prices are per person and include the direct services offered by Yepalo (Moshe Mizrahi ESX9825836Y) - VAT included - for the indicated minimum group. Unless expressly stated otherwise, the contracting of external services (accommodation, transport...) will be taken care of by the client, although to facilitate such services, they can sometimes be managed by Yepalo (Moshe Mizrahi ESX9825836Y).

The necessary material, both individual and collective, is included in the price. Each activity description sheet specifies the necessary equipment for each activity and program.

Insurance

​

An assistance insurance covering cases of illness and accidents is included in the price of the guided activities. The rental of equipment (with no guide) do not have insurance coverage. Yepalo (Moshe Mizrahi ESX9825836Y holds a policy of:

• Civil liability with AXA (policy number: 82699560)

• Healthcare with AXA company with policy number: 82694607

Contract conditions

​

In order to confirm a reservation, the client must pay the amount requested during the booking process of the activity. The remaining amount, if any, will be paid before the start of the activity.

​

The client has the right to cancel the activity, though the following conditions apply:

​

• Cancellation more than 72h before the start of the activity: 50% of the total amount is due (according to the amount of the down payment you have made, the difference will either be requested or refunded).

​​

• Cancellation less than 72h before the start of the activity: 100% of the total amount is due. In the event that the down payment is lower than the total price of the activity, the remaining amount will be requested.

​​

The no-show on the date and time indicated by Yepalo (Moshe Mizrahi ESX9825836Y) will be considered as an cancellation of the contracted service by the client and will imply the obligation, for the client, to pay the total amount of the reservation.

​

The decision to cancel due to weather or force majeure is the sole responsibility of the activity provider.

In case of cancellation due to weather or force majeure, a plan B with similar characteristics will be offered. Should this not be possible, either the activity will be postponed to a new date or the amount of the reservation will be refunded, unless otherwise specified in the activity description.

​

The company is not responsible for the loss, damage or theft of the clients’ personal belongings and will not address any claim in this regard.

​

Starting from the confirmation of the reservation, the client expressly accepts all of these General Conditions. In the event that a client registers another person, the clients also accepts each of these General Conditions in his/her name.

Data Protection

In compliance with the Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, on the protection of individuals with regard to the processing of personal data and the free movement of these data, and following the Recommendations and Instructions issued by the Spanish Agency for Data Protection (AEPD), IT IS INFORMED THAT:

The personal data requested and provided by you, are incorporated a privately owned file whose responsible and only recipient is Yepalo (MOSHE MIZRAHI X9825836Y).

​

Only those data strictly necessary to adequately provide the requested services will be requested, and it may be necessary to collect contact data from third parties, such as legal representatives, guardians, or dependents persons designated by them.

​

All data collected are kept under a confidentiality commitment, with security measures established by law, and under no circumstances are ceded or treated by third parties, physical or legal, without the prior consent of the client, guardian or legal representative, except in those cases cases in which it is essential for the adequate provision of the service.

​

Once the relationship between the company and the client is finished, the data will be archived and kept for a period of at least 2 years, after which it will remain archived or alternatively will be returned in full to the client or legal authorized person.

​

The data provided will be included in database called Yepalo Clients (MOSHE MIZRAHI X9825836Y), with the purpose of managing the contracted service, issuing invoices, contracts... and all the procedures related to clients.

​

Yepalo (MOSHE MIZRAHI X9825836Y) reserves the right to make communications through instant messaging systems such as WhatsApp in order to streamline the management of contracted services.

The client may exercise the rights of data access, rectification, cancellation and opposition, indicating it in by writing to Yepalo (Moshe Mizrahi X9825836Y) at the address: Calle Varsovia 123, 1º-2ª, 08041 Barcelona, SPAIN.

The personal data may be transferred by Yepalo (MOSHE MIZRAHI X9825836Y) to the entities that provide services to it.

Publication of images and videos

With the inclusion of new technologies within the communications, publications and commercial actions that Yepalo (Moshe Mizrahi X9825836Y) can carry out and the possibility that these may include the personal data and/or images that you have provided to our entity within the link existing commercial, and since the right to one's own image is recognized in Article 18 of the Constitution and regulated by Law 1/1982, of May 5, on the right to honor, personal and family privacy and one's own image and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data, Yepalo (Moshe Mizrahi X9825836Y ) asks for the client’s consent to be able to publish the personal data you have given us or images in which they appear individually or in groups that can be made commercially with the company.

The client authorizes Yepalo (Moshe Mizrahi X9825836Y) to make a commercial use of his/her personal data provided within the commercial relationship in order to be published in:

• The web page and profiles in social networks of the company.

• Films intended for commercial broadcasting.

• Photographs for magazines or publications related to our sector.

Document requested to be signed by the client before the activity

Below is a copy of the declaration contents that the clients will be requested to sign before the start of the activity:

I declare, under my entire responsibility, that:

​

• I can swim (only in case of activities that take place in the aquatic environment) and voluntarily attend the contracted activity.

• I am not in a state of gestation, do not suffer from cardiovascular diseases, nor any other injury that prevents me from carrying out activities without risking my health and, in view of the risk, I have consulted a doctor.

• If wearing a prosthesis (including silicone ones), I personally assume the risk of damage it may suffer during the contracted activity.

• I do not suffer from asthma, epilepsy, diabetes, schizophrenia or similar disorders.

• I am of legal age and/or have the permission of my legal representative to practice the activity.

• The activity and the risks that it entails have been explained to me, as well as the behaviors that must observed.

• I will be accompanied by a guide or monitor, whose instructions I commit to follow and assume responsibility for any act I perform that contradicts these indications.

• I am not under the influence of alcohol, drugs or any medication that could compromise my stability, reflexes or otherwise affect my ability, or endanger myself or those around me.

• I know the existence of assistance or accident insurance and civil liability.

• All the technical and safety material for the practice of the activity has been provided.

• I authorize Yepalo (Moshe Mizrahi ESX9825836Y) to use photographic / video material for promotional purposes.
